Start-up and Innovator Visa Business Plans

There have been recent changes to the way in which non-EEA nationals are required to apply for a visa that allows them to establish and run a business within the UK.  As part of the application process, a detailed Business Plan is required to explain their ideas and business strategy. Two Visa Options

With business-friendly regulations, a competitive tax environment, an educated and talented workforce, and renowned legal and financial systems, the UK is one of the most attractive destinations in the world for entrepreneurs to set up and grow their business. From 29th March 2019, the UK Government discontinued the UK ’Tier 1 Entrepreneur Visa’ category, replacing it with the ’Start-up Visa’ and ’Innovator Visa’ categories.

The Start-up and Innovator visa categories are for non-EEA nationals wishing to set up a business in the UK. To qualify for a visa in either category, applicants must first obtain endorsement from an authorised endorsing body if they can demonstrate that their business idea is a new venture, innovative, viable, and scalable.


The Start-up Visa category is for ambitious entrepreneurs in the early stages of their business who are considered to have high potential and wish to establish a business in the UK for the first time.

  • Applicants do not need any funds to invest in their business at this stage, and must not have previously set up a business in the UK.

  • Successful applicants are granted leave for 2 years and can also bring their family members (spouses/partners and children under 18) to the UK.

  • During the granted period of leave applicants will spend the majority of their time developing their businesses but can also take on other work outside of their businesses, to support themselves.

  • At the end of 2 years, Startup visa holders can switch into the Innovator category to extend their stay and develop their businesses in the UK.

The Innovator Visa category is for more experienced business people wishing to set up an innovative business in the UK.

  • Applicants will need a minimum £50,000 funding available to invest in their business.

  • Successful Innovators are granted leave for 3 years at a time and can also bring their family members (spouses/partners and children under 18) to the UK.

  • Innovators must work entirely on developing their business ventures and may not take on other employment outside their business. This includes anything which effectively amounts to employment, such as using their own business to hire out their labour to another employer.

  • After 3 years, Innovators can apply to extend their stay for a further 3 years or to settle permanently in the UK. Each of these 3 stages (initial application, extension, settlement) requires endorsement from an endorsing body.

The key requirement for both Start-up and Innovator Visas is the need to obtain an endorsement letter from an approved endorsing body. The endorsement letter needs to show that all applications for the Visa have been assessed for three key criteria:

Innovation: The applicant must prove they have a genuine, original business plan that meets new or existing market needs and/or creates a competitive advantage.

Viability: The applicant has the necessary skills, knowledge, experience, and market awareness to successfully run the business.

Scalability: The applicant must evidence structured business planning and the potential for job creation and growth into national and international markets.

The endorser must also be “reasonably satisfied that the applicant will spend the majority of their working time in the UK on developing business ventures”.

Extension applications for Tier 1 (Entrepreneur) migrants will remain open until 5 April 2023, and settlement applications until 5 April 2025.
